Discover Live Experience Voucher Terms and Conditions

By purchasing, redeeming, or using a Discover Live Experience Voucher, you expressly agree to be bound by the following Experience Voucher Terms and Conditions.

I. Definitions

  • “Company” shall refer to Discover.live, Inc., its subsidiaries and affiliates.

  • “User” shall specifically mean the individual or entity who is a customer of Company, seeking virtual live-streaming tour experiences (or "Experiences") from Company. User seeks to engage Company to provide services virtually as more fully set forth in this Experience Voucher Terms and Conditions (“Voucher Agreement”), subject to the Voucher Agreement stated herein.

  • “Purchaser” refers to the individual or entity who buys an Experience Voucher from the Company.

  • “Holder” or “Recipient” refers to the individual who possesses and uses the Experience Voucher for redemption.

  • “Experiences” are live video/audio streaming and/or recorded content offered to Company’s Users. Experiences are delivered via Zoom / WebEx using Company’s assigned meeting links or via any other platforms assigned by Company.

  • “Experience Voucher” is the overarching term for a value instrument purchased from the Company that entitles the Holder to future goods or services. This includes a Private Tour Reservation Credit and a Prepaid Tour Pass.

  • “Private Tour Reservation Credit” is an Experience Voucher purchased for a specific monetary amount that serves as a non-refundable prepayment toward the final, variable cost of a custom-booked Private Tour.

  • “Prepaid Tour Pass” is an Experience Voucher purchased for a fixed price that grants the Holder access to a specific, defined, non-monetary subscription service (e.g., "Tourist - Up to 4 Group Tours Monthly" or a specific duration of access). It represents a prepaid service contract for a defined period or quantity.

 

II. General Terms and Conditions (Applicable to All Experience Vouchers)

1. Acceptance and Priority The Purchaser and the Holder agree to this Voucher Agreement when the Experience Voucher is purchased or redeemed. These terms are in addition to the Discover Live Terms and Conditions, and except as explicitly stated, the Discover Live Terms and Conditions and Privacy Policy apply in full to Experience Vouchers (“Voucher”). All capitalized terms not defined here have the same meaning as stated in the Discover Live Terms and Conditions. Nothing in this Voucher Agreement shall be construed to amend or contradict the Discover Live Terms and Conditions unless explicitly stated. If there is a conflict between the Discover Live Terms and Conditions and the Voucher Agreement, the Voucher Agreement controls.

2. No Expiration and No Fees Experience Vouchers (including the monetary value of a Private Tour Reservation Credit and the funds underlying a Prepaid Tour Pass) shall not expire. The funds associated with the purchase of any Experience Voucher do not expire. No dormancy, inactivity, service, or other fees will be charged against the value of any Experience Voucher at any time.

3. Redemption Voucher may only be applied toward the purchase of eligible Experiences or services on the site. Experiences or services purchased are deducted from the Voucher balance. If a purchase exceeds the existing Voucher balance, the remaining amount due must be paid with another method. To redeem the Voucher, the Holder must follow the instructions provided. It may take up to 48 hours for the Voucher code to become active in our system.

4. Limitations and Risk of Loss Voucher may only be applied to the purchase of an Experience or service at checkout. Voucher cannot be reloaded, resold, refunded, transferred for value, or redeemed for cash, or credits in any other forms, except to the extent required by law, such as for statutory small remaining balances in certain jurisdictions. Voucher is not valid with any other offer or discount. Voucher is subject to availability. It is the Holder's responsibility to utilize the Voucher. Company will not replace lost or stolen Vouchers provided by third-party resellers.

Voucher can only be purchased by or gifted to individuals in the United States, not including US territories and possessions. Voucher is void where prohibited or restricted by law. Company reserves the right to refuse service or reverse any Voucher purchase for any reason and return the funds to the original Purchaser. Voucher cannot be used to purchase other Experience Vouchers.

The Holder should treat Voucher like cash. The risk of loss and title for Voucher is on the Purchaser or Recipient upon electronic transmission. Company is not responsible if any Voucher is lost, stolen, destroyed, or used without permission.

5. Delivery and Accuracy Voucher will be emailed to the Purchaser-provided recipient(s) email address(es). The Purchaser is responsible for ensuring the recipient's email address is correct. Company will not be held responsible for incorrect email addresses and unintended use. Every Voucher has a unique Voucher number which is required for redemption. Risk of loss will pass to the original Purchaser or Recipient upon the electronic transmission of such Voucher to the original Purchaser or Recipient.

6. Fraud and Invalidation Company reserves the right to refuse to issue or honor a Voucher, in the event of suspected fraud or unauthorized use. Company reserves the right to immediately invalidate the Voucher, without notice, should it receive a credit card charge back, returned check or other form of repudiated payment made towards the Voucher.

7. Service Changes Company reserves the right to discontinue the sale of any Experience or service purchased using a Voucher but agrees to replace the Experience or service with another Experience or service of the same value.

 

III. Product Specific Terms

1. Private Tour Reservation Credit

  • The Credit is a Prepayment: The Private Tour Reservation Credit is a monetary non-refundable prepayment applied directly toward the final, variable cost of a custom-booked Private Tour. The final tour price is subject to factors including, but not limited to, guide rates, duration, and customization choices. If the final price exceeds the credit balance, the remaining amount due must be paid with another accepted payment method.

  • Booking Obligation: While the monetary value does not expire, the Holder is responsible for initiating the booking process for a private tour. The Company is not responsible for the availability of any specific guide or tour on any date or time.

2. Prepaid Tour Pass

  • Pass is a Service Contract: The Prepaid Tour Pass is an entitlement to a specific, defined, non-monetary service (e.g., "Tourist - Up to 4 Curated Group Tours Monthly" or a specific duration of access). The Pass's validity (e.g., the monthly term) is the duration of the service contract for access to Experiences, not an expiration of the monetary funds. The unused monetary value remains available for future service purchase indefinitely in accordance with Section II, Clause 2 (No Expiration and No Fees).

  • New Clause: Subscription Continuity: The Prepaid Tour Pass grants access for a continuous fixed duration (e.g., 6 months from the date of activation). This service duration cannot be paused, suspended, or put on hold by the Holder or Purchaser for later use.

  • Unused Tour Allotment: Unless otherwise explicitly stated in the specific Pass terms at the time of purchase, any unused tour allotment within a given period of the Prepaid Tour Pass does not roll over to subsequent periods.

 

IV. General Legal Provisions

1. Severability and Waiver If any provision of the Voucher Agreement is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Voucher Agreement will continue in full force and effect. No waiver by Company of any Terms and Conditions set out in these Voucher Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Company to assert a right or provision under these Voucher Terms shall not constitute a waiver of such right or provision. A court of competent jurisdiction is hereby empowered to modify any invalid, prohibited, or unenforceable provision to make it valid and enforceable.

2. Updates to the Voucher Agreement Company may revise and update these Voucher Terms from time to time at the company's sole discretion. All changes are effective immediately upon posting them and apply to all access to and use of the site thereafter. However, any changes to the dispute resolution provisions set out in Venue and Applicable Law will not apply to any disputes for which the parties have actual notice on or before the date the change is posted on the site. Users' continued use of the site and purchase of Voucher and Experiences following the posting of revised Voucher Terms means that users accept and agree to the changes. User is expected to check this page from time to time so User is aware of any changes, as they are binding on User.

3. Warranty COMPANY AND ITS AGENTS AND AFFILIATES, MAKE NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO VOUCHER, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

4. Venue and Applicable Law Voucher, and the Voucher Agreement is subject to and governed by the laws of New York, without reference to its principles of conflicts of law.

5. Without Recourse Company is the Voucher issuer and sole obligor to the Voucher owner. Company may assign its issuer obligations to an assignee, without recourse. If delegated, the assignee, and not Company will be the sole obligor to Voucher owner. Purchaser use or acceptance of Voucher constitutes acceptance of these Terms.
